1. Introduction
These Terms & Conditions (“Terms”) govern your use of the website hydramarts.com (referred to as “the Site”), operated by Hydramarts. By accessing or placing an order on the Site, you accept and agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Definitions

  • “Customer”, “you”, “your” means the person who uses the Site or places an order.

  • “We”, “us”, “our”, “Hydramarts” means the operator of the Site.

  • “Products” means the goods available for purchase on the Site.

  • “Order” means your request to purchase Products from us via the Site.

  • “Contract” means the contract formed when we accept your Order.

3. Availability of Products, Orders & Acceptance

  • All Products are subject to availability and to our acceptance.

  • When you place an Order, you offer to buy Products subject to these Terms. We may accept your Order by sending you a confirmation email or by dispatching the goods, at which point the Contract comes into existence.

  • We reserve the right to decline or cancel any Order for reasons including (but not limited to) product unavailability, incorrect pricing, suspected fraud, or failed payment.

4. Pricing and Payment

  • Prices displayed on the Site are in Nigerian Naira (NGN), inclusive of any applicable taxes unless otherwise stated.

  • You agree to pay the price shown at checkout, plus any delivery/shipping costs where applicable.

  • Payment must be made by one of the methods we offer (for example bank transfer, mobile payment, card payment, etc.).

  • We are not obliged to fulfill an Order until we receive full payment.

5. Delivery / Shipping

  • Currently we ship to the State of Lagos in Nigeria (or as may be updated).

  • Delivery times are estimates only and commence from the date of dispatch. We are not liable for delays outside our control.

  • You remain responsible for providing accurate delivery address details.

  • Title and risk in the Products pass to you upon delivery.

6. Cancellation & Returns

  • You have the right to cancel your Order in line with applicable Nigerian consumer protections and our Returns Policy.

  • The Products must be returned in the same condition in which you received them, unused and with all original packaging unless the Product is defective.

  • Custom or perishable goods may not be eligible for return or cancellation.

  • Any refunds will be processed within a reasonable time once returned goods are received and inspected.

7. Bank Transfer Method (Specific Instructions)

  • If you select bank transfer as your payment method, you will be shown our bank account details and a prompt to contact us (for example via WhatsApp) before completing payment.

  • Until payment is confirmed and the order is manually transitioned (on hold → completed) in our system, the order remains inactive and your cart may remain reserved for a limited time.

  • You must ensure your payment reference clearly includes your Order Number to enable confirmation.

8. Accounts & Security

  • If you create an account on the Site, you agree:

    • To provide true, accurate, up-to-date information.

    • To keep your account login details secure and not share them.

    • To notify us immediately of any security breach.

  • We reserve the right to suspend or cancel your account or any Orders if we believe you are in breach of these Terms.

9. Intellectual Property

  • All content on the Site (text, graphics, logos, icons, images, software) is owned or licensed by us.

  • You may view and print content for personal use only. You may not reproduce, transmit, distribute or exploit any content without our written permission.

10. Limitation of Liability

  • To the maximum extent permitted by law, we exclude all liability for loss or damage (direct or indirect) arising from your use of the Site or Products you purchase, except where caused by our negligence or wilful misconduct.

  • Nothing in these Terms will exclude or limit our liability for death or personal injury caused by our negligence.

11. Changes to these Terms

  • We may amend these Terms at any time by posting updated Terms on the Site. Your continued use of the Site after changes indicates your acceptance of the new Terms.

  • The version published at the date of your Order will apply to that Order.

12. Governing Law & Jurisdiction

  • These Terms are governed by the laws of the Federal Republic of Nigeria.

  • You and we agree to submit to the exclusive jurisdiction of the courts of Nigeria in respect of any dispute.
